Welcome to BYM Digital. By accessing or using our platform, you agree to be bound by these Terms of Service. Please read them carefully.

1. Acceptance of Terms

By creating an account or using any part of BYM Digital, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the service.

2. Description of Service

BYM Digital provides a marketing CRM platform that includes:

• Official WhatsApp Business Cloud API messaging and customer live chat
• Email marketing and campaign management
• Lead and contact management
• Template creation and automation tools
• Analytics and reporting

3. Account Registration

You must provide accurate, complete information when creating an account. You are responsible for maintaining the security of your account credentials and for all activities that occur under your account.

4. Acceptable Use

You agree NOT to use BYM Digital to:

• Send spam, unsolicited messages, or phishing content
• Violate any applicable laws or regulations
• Infringe on intellectual property rights of others
• Distribute malware, viruses, or harmful code
• Harass, threaten, or defame any person
• Circumvent rate limits, security measures, or access controls

We reserve the right to suspend or terminate accounts that violate these terms.

5. WhatsApp & Meta Platform Compliance

If you connect and use the Official WhatsApp Business API through our platform, you agree to strictly comply with all applicable Meta policies, including Meta's WhatsApp Business Policy, Commerce Policy, and Meta Developer Terms.

• You must obtain clear, verifiable opt-in consent from recipients before initiating WhatsApp messages.
• Sending unsolicited bulk spam, deceptive content, or messages violating Meta's acceptable commerce categories is strictly prohibited and constitutes grounds for immediate account termination without refund.
• Trademark Disclaimer: WhatsApp and Meta are registered trademarks of Meta Platforms, Inc. BYM Digital is an independent software platform integrating with Meta Cloud APIs and is not directly owned by or affiliated with Meta Platforms, Inc.

6. Email Compliance

All email campaigns must comply with applicable anti-spam laws including CAN-SPAM, GDPR, and India's IT Act. Every marketing email must include a working unsubscribe mechanism.

7. Payment & Billing

Paid plans are billed monthly or yearly as selected. Prices are in INR and exclusive of applicable taxes. We reserve the right to change pricing with 30 days' notice.

8. Refund Policy

We offer a 7-day money-back guarantee on all paid plans. After 7 days, payments are non-refundable. Contact support@flowbiz.in for refund requests.

9. Data Ownership

You retain ownership of all data you upload or create on BYM Digital. We do not claim ownership of your contacts, templates, or campaign data. You may export your data at any time.

10. Service Availability

We strive for 99.9% uptime but do not guarantee uninterrupted service. We are not liable for downtime caused by maintenance, third-party services, or events beyond our control.

11. Limitation of Liability

BYM Digital is provided "as is" without warranties of any kind. In no event shall we be liable for indirect, incidental, or consequential damages arising from your use of the platform.

12. Termination

Either party may terminate the account at any time. Upon termination, your data will be retained for 30 days, after which it may be permanently deleted.

13. Changes to Terms

We may update these Terms periodically. Continued use of the platform after changes constitutes acceptance of the new terms. We will notify you of significant changes via email.
